Lux Travel Terms and Conditions

 

 

Welcome to Lux Travel, LLC. We are pleased to assist you with your travel arrangements. These Terms and Conditions (the “Agreement”) outline the services we provide and the expectations governing your booking.

By signing and submitting payment, you acknowledge and agree to all applicable terms and conditions that are provided to you prior to payment. You hereby authorize Lux Travel, LLC to charge the credit card or bank account listed on this invoice for the amount indicated on the date of authorization. This payment applies solely to the travel services detailed on the invoice.

You understand and agree that all sales, refunds, cancellations, and returns are subject to the policies of Lux Travel, LLC and its affiliates, as well as the applicable supplier rules. You further certify that you are the authorized cardholder or account holder and authorize this transaction. You agree not to dispute or initiate a chargeback with your financial institution, provided the charge aligns with the terms and services outlined on this invoice.

Payments

Our merchant account accepts Visa, Mastercard, and American Express, allowing clients to conveniently submit payments using major credit or debit cards. Cash not accepted.

Passports and Visas

All passengers are solely responsible for ensuring they have the proper travel documentation required for their trip. Travelers must verify current passport and visa requirements directly with the appropriate consulate(s) or a licensed visa service, as entry requirements may change at any time.

Passports must be valid for at least six (6) months beyond the return date of travel. Some destinations also require at least one full blank visa page in the passport for entry or exit stamps.

Any travel information provided is applicable to U.S. citizens only. Non-U.S. citizens must consult the consulate of the country or countries being visited to confirm specific entry requirements.

While some cruise itineraries may allow alternative documentation, it is strongly recommended that all cruise passengers travel with a valid passport for ease of travel and in the event of an emergency.

Travel Protection Disclosure

All payments made toward your reservation are non-refundable and non-transferable, under any circumstances, including but not limited to illness, injury, personal emergencies, work conflicts, weather, or changes of mind.

Because of this strict no-refund policy, we strongly encourage all travelers to purchase third-party travel insurance to protect against the unexpected — including trip cancellation, trip interruption, medical expenses, baggage loss or delay, and other unforeseen circumstances. Travel insurance is optional and offered for the traveler’s convenience; it is the traveler’s sole responsibility to review, select, and purchase a policy that meets their needs at the time of booking.

Lux Travel, LLC does not underwrite, administer, or guarantee any travel insurance policy and is not responsible for a claim being approved, denied, or the terms of coverage, including whether a specific event, illness, or circumstance qualifies for reimbursement. Any questions regarding coverage, claims, or eligibility should be directed to the insurance provider directly.

Travelers who decline to purchase travel insurance acknowledge and accept that all funds paid toward their reservation are permanently non-refundable, regardless of the reason for cancellation or inability to travel.

Payment Schedule & Minimum Payment Requirement

To keep a reservation active, travelers must make a minimum payment of $100 toward their trip balance at least once every sixty (60) days from the date of the initial deposit, until the trip is paid in full by the Final Payment Due date.

It is the traveler’s responsibility to make timely payments and to stay in contact with Lux Travel, LLC regarding their reservation. If a period of sixty (60) days passes without either a qualifying payment or communication from the traveler, Lux Travel, LLC reserves the right, at its sole discretion, to cancel the reservation.

In the event of a cancellation resulting from non-payment or lack of contact under this policy, all amounts previously paid are forfeited in accordance with the Cancellation Policy below and will not be refunded or credited toward a future booking.

Lux Travel, LLC will make reasonable attempts to reach the traveler by email or phone prior to cancelling a reservation for non-payment, but is under no obligation to do so, and a missed attempted contact does not extend the 60-day window.

Covid-19 Guidelines

Travelers are responsible for regularly reviewing official airline, hotel, and destination websites for the most current travel requirements and guidelines. It is the traveler’s responsibility to ensure that all required testing, documentation, and entry requirements are completed and available prior to arrival at the airport.

Lux Travel LLC is not responsible for missed flights, denied boarding, or accommodation issues resulting from incomplete, missing, or incorrect travel documents.

Travel Documents: Provided full payment is received no later than your Final Payment Due date, travel documents, and travel instructions will be sent via email within 30 days of travel!

Cancellation Policy

All payments — including deposits and final payments — are non-refundable and non-transferable once submitted, regardless of the reason for cancellation.

Any cancellation requests must be submitted in writing to Lux Travel, LLC. Submitting a cancellation request does not entitle the traveler to a refund, credit, or transfer of funds. No refunds, credits, or compensation will be provided for unused services, missed portions of travel, no-shows, or voluntary changes made before or after travel has begun.

This policy also applies to any reservation cancelled by Lux Travel, LLC due to a traveler’s failure to meet the minimum payment requirement described in the Payment Schedule & Minimum Payment Requirement section above. Amounts already paid on such a reservation are forfeited and non-refundable.

Travelers who wish to protect their investment against unforeseen circumstances are strongly encouraged to purchase travel insurance at the time of booking, as outlined above. Lux Travel, LLC will not make exceptions to this policy regardless of circumstance, and no verbal or written representation by any employee or representative of Lux Travel, LLC shall modify this policy unless done so in writing signed by an authorized officer of Lux Travel, LLC.

Hotel Accommodations & Check-In Policy

Lux Travel, LLC and its affiliates assume no responsibility for resort fees, hotel-imposed charges, room taxes, or refundable security deposits that may be required by the property at check-in or during the stay.

Unless otherwise stated or requested, all room reservations are made for standard twin-bedded rooms (two double beds) with private facilities. Requests for alternative bed types, including king or double beds, will be submitted on your behalf; however, all bed type requests are subject to availability and cannot be guaranteed.

Room assignments are determined solely by the hotel on a run-of-house basis at the discretion of hotel management.

Hotel check-in time is typically after 3:00 p.m., and check-out is prior to the hotel’s designated departure time.

Health Requirements

Travelers are advised to consult their healthcare provider for the most current health and vaccination requirements. Additional guidance may also be obtained through the Centers for Disease Control (CDC) and the World Health Organization (WHO) for recommended travel health information.

It is the traveler’s responsibility to inform Lux Travel, LLC of any special requests or accommodations, including medical needs or accessible room requirements, at the time of booking.

Code of Conduct – Group Travel

All travelers participating in group bookings are expected to conduct themselves in a respectful, courteous, and responsible manner at all times. Disruptive, abusive, threatening, unsafe, or inappropriate behavior toward other travelers, hosts, vendors, or staff will not be tolerated.

Lux Travel, LLC reserves the right, at its sole discretion, to remove or restrict participation of any traveler whose behavior negatively impacts the experience, safety, or enjoyment of the group. This may include removal from group activities, transportation, accommodations, or the trip in its entirety.

No refunds or compensation will be issued for any unused services resulting from such action. Any additional costs incurred as a result of inappropriate conduct shall be the sole responsibility of the traveler.

By booking a group trip, travelers agree to adhere to this Code of Conduct and accept responsibility for their behavior throughout the duration of the trip.

Force Majeure / Act of War Clause

Lux Travel shall not be held liable or responsible for any delay, cancellation, interruption, or change to travel services resulting from circumstances beyond its control. These circumstances may include, but are not limited to, acts of war, terrorism, civil unrest, government actions, travel bans, natural disasters, epidemics or pandemics, strikes, weather conditions, airline disruptions, or other unforeseen events considered Force Majeure events.

In the event such circumstances occur, Lux Travel reserves the right to modify, postpone, or cancel travel arrangements as required by suppliers or governing authorities. Any refunds, credits, or rebooking options will be subject to the policies and terms of the travel suppliers, including airlines, hotels, cruise lines, and tour operators.

Lux Travel will make reasonable efforts to assist travelers in adjusting travel plans but shall not be responsible for any additional costs, losses, damages, or expenses incurred as a result of such events.

Travel Advisory & Government Restrictions Clause

Travelers are responsible for reviewing any travel advisories, entry requirements, health requirements, and government regulations related to their destination prior to departure. Lux Travel is not responsible for any traveler being denied boarding, denied entry into a country, or required to quarantine due to failure to comply with government requirements, documentation requirements, passport validity rules, or health regulations.

Travelers are responsible for ensuring they have valid travel documents including passports, visas, identification, and any required vaccinations or health documentation.

Supplier Responsibility Clause

Lux Travel acts solely as an agent for travel suppliers including airlines, hotels, cruise lines, transportation providers, and tour operators. Lux Travel is not responsible for the acts, errors, omissions, negligence, or performance of these third-party suppliers.

All bookings are subject to the terms and conditions of the respective travel suppliers. Lux Travel shall not be liable for any injury, loss, accident, delay, or irregularity that may occur due to the actions or services provided by these suppliers.

Release of Liability

Lux Travel, LLC does not own, manage, operate, or control any entity that provides goods or services related to your travel arrangements. This includes, but is not limited to, airlines, cruise lines, hotels or other lodging facilities, motorcoach, bus, van or other transportation providers, local ground operators, excursion providers, equipment suppliers, food service providers, and entertainment vendors. All such suppliers are independent contractors.

Accordingly, Lux Travel, LLC is not responsible for any negligent, reckless, or willful acts or omissions of these independent contractors or any other third parties.

Without limitation, Lux Travel, LLC shall not be liable for any injury, loss, damage to person or property, death, delay, inconvenience, or expense arising out of or related to the provision of travel-related goods or services. This includes, but is not limited to, events resulting from acts of God, governmental actions, force majeure, war, civil unrest, labor disputes, criminal or terrorist activity (or the threat thereof), overbooking or downgrading of accommodations, defective conditions in lodging facilities, mechanical or operational failures of transportation, delays or cancellations, animal or insect bites, marine life or vegetation, sanitation issues, foodborne illness, lack or quality of medical care, difficulties in evacuation, medical emergencies, illness, epidemics or pandemics (or the threat thereof), or any other circumstances beyond the direct control of Lux Travel, LLC.

This also includes risks associated with recreational and adventure activities, including but not limited to swimming, kayaking, sailing, canoeing, rafting, hiking, walking, bicycling, horseback riding, ATV excursions, and similar activities, whether booked independently or through third-party providers.

By booking travel through Lux Travel, LLC, the traveler voluntarily assumes all risks associated with travel and hereby releases Lux Travel, LLC from any liability, including claims arising from Lux Travel, LLC’s own negligence, to the fullest extent permitted by law.

Assumption of Risk

I acknowledge that the travel activities I am undertaking may involve inherent risks, including the possibility of illness, injury, or death. These risks may arise from natural forces, environmental conditions, wildlife, insects, or vegetation, as well as from participation in recreational or adventure activities. I understand that weather conditions may be extreme, unfavorable, or uncomfortable, and that access to medical services or emergency facilities may be limited or unavailable during portions of the trip.

In consideration of the opportunity to participate in this travel experience, I knowingly and voluntarily accept all risks and uncertainties associated with the trip as an inherent part of the experience. I agree to hold harmless and release Lux Travel, LLC from any claims arising from the acts or negligence of third parties.

I confirm that I understand the physical demands of the activities in which I may participate and that I do not have any known physical, medical, or mental condition that would prevent safe participation. I knowingly assume all risks that may arise, directly or indirectly, from any such condition.

I further authorize Lux Travel, LLC, its agents, local ground operators, or service providers to arrange emergency medical treatment or hospitalization on my behalf should such care become necessary during my travels.

Binding Arbitration

Any claim, dispute, or controversy arising out of or connected to this Agreement, any travel materials or descriptions provided, or the trip itself shall be resolved solely through final and binding arbitration in accordance with the Federal Arbitration Act (9 U.S.C. §§ 1–16). Arbitration shall be conducted under either the Commercial Arbitration Rules of the American Arbitration Association (AAA) or the Comprehensive Arbitration Rules and Procedures of JAMS, as applicable at the time the claim is filed.

The arbitration shall be governed by the substantive laws of the Commonwealth of Virginia, excluding procedural rules, and shall be held in Chesapeake, Virginia. The arbitrator shall have exclusive authority to determine all issues relating to the interpretation, validity, scope, enforceability, or formation of this Agreement, including any claim that this Agreement, in whole or in part, is invalid or unenforceable.

By agreeing to these terms, both parties expressly waive the right to have disputes decided in a court of law or by a jury, and instead agree to resolve all disputes through binding arbitration.

Voluntary Participation

I confirm that I have willingly applied to participate in the travel experience identified in this application and that I have reviewed the trip details as presented on the current Lux Travel, LLC website, along with all related information provided herein. I understand the nature of the trip and choose to participate voluntarily, with full awareness of any risks or hazards that may be associated with travel and related activities.

Non-Seller / Residency Restriction

At this time, Lux Travel, LLC does not sell or provide travel services to residents of the following states: California, Florida, Hawaii, Iowa, and Washington. Any bookings made by residents of these states are not eligible for service and may be subject to cancellation.

It is the traveler’s responsibility to ensure eligibility prior to booking. Lux Travel, LLC reserves the right to decline, void, or cancel reservations that do not meet residency requirements.

Photographic & Media Release

Lux Travel, LLC may photograph or record video during its trips. By participating, travelers grant Lux Travel, LLC permission to use any images, video, or likeness captured during the trip for promotional, marketing, or commercial purposes, without compensation or further approval.

Website Liability Disclaimer

The information, products, and services presented on this website may contain errors, omissions, or typographical inaccuracies. Updates, revisions, and changes may be made periodically and without prior notice. Lux Travel, LLC does not guarantee that website content is complete, current, accurate, or continuously available and reserves the right to modify or update the site at any time.

Under no circumstances shall Lux Travel, LLC be liable for any direct, indirect, incidental, punitive, special, or consequential damages arising from or related to the use of this website, including but not limited to reliance on any information, products, or services obtained through the site or the inability to access or use the site.

Knowing and Voluntary Execution

I affirm that I have carefully reviewed and understand these Travel Terms and Conditions, including all booking information contained within this document. I acknowledge that this agreement includes a release of liability and constitutes a legally binding contract between myself and Lux Travel, LLC, which I am entering into knowingly and voluntarily.

By signing, I agree to be bound by these Travel Terms and Conditions, including Lux Travel, LLC’s Release of Liability, Assumption of Risk, and Binding Arbitration provisions, on behalf of myself, all members of my traveling party, and any minor children traveling with me.
